I'm going to contact eBay today, this is getting way out of hand.
as quoted from their site:
Counterfeits, unauthorised replicas, unauthorised items (such as counterfeit Dvd’s, watches, handbags, or other accessories) or unauthorised copies (such as copies of software programs, video games, music albums, movies, television programs, or photographs) are not permitted on eBay. Unauthorised copies include (but are not limited to) copies that are pirated, duplicated, backed-up or bootlegged. It is illegal to sell unauthorised copies of media.
Guideline: If the product you are selling bears the name or logo of a company, but it wasn't made or endorsed by that company, don't list it on eBay.
Violations of this policy may result in a range of actions, including:
Listing cancellation
Limits on account privileges
Account suspension
Forfeit of eBay fees on cancelled listings
Loss of PowerSeller status
As an ebay customer I'm going to demand they do somthing about it, if I get a response I'll post it...

Since there site is so bad, and all you can do is submit id's for fake auctions I had to write them a letter, which I faxed to their Melbourne head office (after talking live with someone online from there, they suggested I take that form of action)

I've discovered that Nintendo have a couple of email addresses for such cases. I suggest you report anything you see in Ebay or elsewhere to them directly since Ebay won't do anything about these items for the time being..
auctionpiracy@noa.nintendo.com to report infringing items on internet auction sites, and
piracyscene@noa.nintendo.com to report counterfeit manufacturing or other illegal activities
Take note that these addresses are for Nintendo of America. I'm not sure if they have similar emails for Nintendo Japan (Asia) or Nintendo Europe but they will do for now.
For people living in the US, they also have a phone number to call them directly and it's 1-800-255-3700.
Make good use of the above info!

I'm also wondering if we cant create a "spot" a dodgy list?, get some details together on what to look out for.
i.e. stamp collectors check watermarks etc, surly we can come up with a list of things to check? (or would this just force the perpatrators to be more cunning)
I suspect for most colectors once they have the item in the hands they could spot it straight away, but thats not much use, and with most ebay photos being fairly "vaig" there may not be much we can do.
I guess the basic rule of thumb we can promote is, if it looks to good to be true, it probably is...

Good work Mike! I sincerely think we should start a quest against the copied boxes. Those copied boxes will spoil our hobby and ruin our investment in the end. I was thinking about that too Brendan! For guys like me (who haven't been selling and or buying for a while) and for newbees such a check-list would be very helpful. I als think we should make a list of all the people who either sold our bought copied g&w items. I think we should ban those people for ever from future deals. That means noone should either buy and/or sell to those people again. The basic rule you mention Brendan is a good one for now, but what I fear is that some clever people will intentionally make their copied boxes look a little less good by creating a little tear or crush. Yes, actually this is something we've discussed with Aris in the past. There are certain things you can look out for to spot fake boxes and paperwork. Most experienced collectors already know about them. But I don't think it's wise to talk about it in here since anyone (especially people selling re-creations) can read about it.
I think I should create a section in the forum where only trusted people will have access. Then we can discuss anything about it. What do you think ?

I hadn't thought about it, but it seems like a very smart idea! Just create a subboard with password access and only give access to members that can be highly trusted. I do think we can start a black-list with people that either buy or sell copied stuff in the main forum, for everyone to see.

As I said earlier in another topic, I collect information about hobbymodel to send them to Nintendo. Today I've sent that letter by registered airmail. I did point out that HM is selling selfmade products with the Nintendo logo on it and is making profit out of it. I did write about other things as well, regarding the situation of the fake items. And last but not least, I did include a few printouts of HM's auctions and a link to this forum and one to my database (the search for fake sellers etc.). And I've sent a copy of this letter to eBay USA with a short explanation. I hope this will be helpfull... - Patrick

It was a nice try guys, but it will not work. Ebay doesn't give a s*h*i*t* as long as they make money. Fake or not, they don't care. They only say these things in their policy, because they have to, to avoid claims. They will only act when a big enterprise, like Nintendo, rings the bell. But Nintendo doesn't care because they don't sell these games anymore, i.e. they don't make money with them anymore. Nintendo is too busy with trying to ban the R4DS-cards for the ds and the mod-chips for the Wii.
They don't care about a couple of "nerds" who are trying to protect their hobby.
We'll have to do it ourself. The list and showing the auctions here are a good start. I've been emailing the winners of fake items on ebay and hope that they will cancel the deal and report it to ebay. That way, just maybe, sellers of fake items will loose interest because they can't make enough money.
